Terms and Conditions of Sale

1. Scope
These General Terms and Conditions of Sale (“Terms”) govern all sales of products (“Products”) by ROCES through its online store available at the website rocesrollerskates.com (the “Site”) to consumers and other end users (“Customer” or “you”). These Terms constitute a legally binding agreement between the Customer and ROCES. Any purchase on the Site implies the Customer’s full and unconditional acceptance of these Terms. These Terms prevail over any other general or particular conditions not expressly approved by ROCES.

2. Products
The Products offered for sale on the Site are described and presented with the greatest possible accuracy. However, errors may occur. ROCES reserves the right to correct any errors in Product descriptions, pricing, or availability at any time without prior notice. All Products are subject to availability. ROCES reserves the right to limit the quantity of Products purchased and to discontinue any Product at any time.

3. Orders
To place an order, the Customer must select the Products and add them to the shopping cart, then follow the checkout instructions, providing all requested information. An order is considered completed only after full payment has been received and an order confirmation has been sent by ROCES. ROCES reserves the right to refuse or cancel any order for any reason, including but not limited to Product availability, errors in the Product or order information, or suspected fraudulent activity.

4. Prices and Payment
All Product prices are displayed in the selected currency and include value-added tax (VAT) or other applicable sales taxes, but exclude shipping costs, which are added during checkout. ROCES reserves the right to change prices at any time. Payment is due immediately upon confirmation of the order. The Site uses secure payment gateways. The Customer guarantees that they are authorized to use the chosen payment method.

5. Shipping and Delivery
Products will be shipped to the delivery address provided by the Customer during the checkout process. Shipping costs and estimated delivery times are provided during checkout. ROCES is not liable for delays in delivery caused by force majeure events or beyond its reasonable control. Title and risk of loss for the Products pass to the Customer upon delivery to the carrier.

6. Right of Withdrawal
If you are a consumer within the meaning of applicable law, you have the right to withdraw from this contract without giving any reason within a specified period. The withdrawal period expires after a certain number of days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement. You must then return the Products unused, in their original packaging, and in a saleable condition. You will be responsible for the cost of returning the goods. We will reimburse you the price paid for the Products, excluding shipping costs, without undue delay.

7. Warranty
ROCES Products are covered by a legal warranty of conformity and a warranty against hidden defects, as provided by applicable law. Some Products may also be covered by a commercial warranty. For any warranty claim, the Customer must contact customer service. The warranty does not cover damage resulting from accident, misuse, neglect, wear and tear, or unauthorized modification or repair.

8. Intellectual Property
All content on the Site, including texts, graphics, logos, images, and software, is the property of ROCES or its licensors and is protected by intellectual property laws. The Customer is granted a limited, non-exclusive, non-transferable license to access and make personal use of the Site.

9. Liability
ROCES’s liability in connection with the sale of Products is limited to the purchase price of the Product. ROCES shall not be liable for any indirect, incidental, or consequential damages. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence or for fraud.

10. Force Majeure
ROCES shall not be held liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

11. Privacy
Personal data provided by the Customer for the purpose of purchasing Products is processed in accordance with the Privacy Policy available on the Site.

12. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between the parties regarding the subject matter herein. ROCES’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Governing Law and Jurisdiction
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the country in which ROCES is established, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of that country.

14. Modifications
ROCES reserves the right to modify these Terms at any time. The applicable Terms are those in effect at the time the order is placed.
